Application
Application
Parties jointly fill in the Claim Form and sign the Mediation and Arbitration Agreement.
This must be filed with the Sikh Court together with the relevant fee.
Gatekeeping

The Court Registrar and a single Judge will consider the application and allocate it to either a Magistrate or a Judge.
Allocation and Listing
Allocation and Listing
The Court will give directions of any further evidence required ahead of the next stage.
Mediation and Reconciliation Meetings
Mediation and Reconciliation Meetings
These meetings will be facilitated by a Magistrate who will assist parties to resolve the dispute. In complex cases, a Judge may be assigned to facilitate these meetings.
Arbitration

If the matter is resolved, then a Terms of Settlement agreement will be prepared for the parties to sign.
Matters that are not resolved shall be listed to be determined by a Judge.

Further Hearings (case management; directions; interim decision) shall be dealt with by a Judge (in complex cases a panel).
Any outstanding dispute will be dealt with by a Final Hearing.
Determination
Determination
A determination will be made by the Judge which will be legally binding on all of the parties.

If needed, parties would be able to take the Determination of the Sikh Court to the Courts of England and Wales to convert it into a Court order.
Appeal
Appeal
Determinations of the Sikh Court can be appealed to the High Court but only on points of law, not fact.
